Michigan Automated Court Forms

    MichiganLegalAid.org is pleased to offer a selection of Michigan court forms which have been automated using HotDocs® technology kindly donated by LexisNexis®.

    This technology allows users to complete court forms by responding to a series of online queries and prompts, then print them out and file in the appropriate court as needed.

Instructions:

    To access specific forms, which are grouped according to how they are used, click on the appropriate item in the list below. You will then be prompted to either register for a confidential account, which is necessary if you want to be able to save incomplete forms and return later to finish them, or to go directly to the form you want to fill out. Please make sure you are using Internet Explorer when completing the forms - at this time other browsers will not work with Hot Docs® properly.

NOTE: Our interactive forms are provided solely for the benefit of low income users of MichiganLegalAid.org. A full selection of Michigan court forms available to the general public for printing and filling out manually is available at http://courts.michigan.gov/scao/courtforms/.

FEE WAIVER FORM

    The Court charges filing fees in many types of cases. If you are receiving public assistance or are low income, these fees will be waived by the Court.

•   MC 20 - Suspension of Fees - Use this form to ask the Court to waive fees.

SMALL CLAIMS FORMS


•  DC 84 - Affidavit and Claim - This form can used to start a lawsuit in Small Claims Court, up to $3,000.

•  DC 85 - Small Claims Judgment - Use this form so that the Judge's decision is in writing.

•  DC 86 - Demand and Order for Removal - If you are sued in Small Claims Court and want to have the case heard by
                                                                a Judge in a "court of record", you need to use this form.

DEFAULT JUDGMENT FORM


•  DC 99 and 99a - Motion and Affidavit to Set Aside Default and Order - If a Judgment has been entered against you
                                                                                                         because you did not go to Court, use this form.
                                                                                                         (Small Claims / General Civil / Landlord-Tenant)

GARNISHMENT FORMS

    If there is a Judgment against you and you agree that you owe it but need a "payment plan", you can ask the judge to order installment payments and you cannot be garnished so long as you stay current in your payments. Use these forms to ask the Court to set up a plan.

•   DC 87 - Affidavit of Judgment Debtor - Use this form to collect a judgment after the Judge signs it.

•  MC 15 - Motion for Installment Payments - Use this form to ask the Court to allow you to make installment payments
                                                               on a garnishment.

•   MC 15a - Order Regarding Installment Payments - Use this form with MC 15 when you ask the Court to allow you to
                                                                          make installment payments.

    If you are garnished, you can object (1) if the Judgment has been paid, (2) if the account that the creditor is trying to get contain protected funds such as Social Security. Use the following forms to object.

•   MC 49 - Objections to Garnishment - Use this form to object to a garnishment.

•   MC 51 - Order on Objections to Garnishment - Use this form with MC 49 when objecting to a  garnishment.

SET ASIDE CONVICTION FORM


•  MC 227 and 228 - Application to Set Aside Conviction and Order - If you have only 1 conviction and more than 5 years
                                                                                                    have passed since you served your sentence,
                                                                                                    you may be able to use this form to have your
                                                                                                    conviction "expunged." (See "how to")

•  PC 100, 101, 79, and 564 - Petition for Emancipation and Order, Summons, and Proof of Service

•  PC 556 - Small Estate: Petition and Order for Assignment

•  PC 625, 562, 631, 633, 571, and 564 - Guardianship Petition and Order, Letters, Notice of Duty to Visit, Acceptance of Appointment, and Proof of Service

•  PC 634 - Annual Report of Guardian on Condition of Legally Incapacitated Individual

•  PC 639, 640, 645, 577, 562, 564, and 571 - Petition for Appointment of Conservator and Order, Letters, Inventory, Notice of Hearing, Acceptance of Appointment, and Proof of Service
